Terms and Conditions

Cactus Graphics provides custom decorating, embroidery, and promotional  products and industry consulting services. By  engaging in a transaction,  or any correspondence regarding a potential order initiated either by our website or through alternative means,  you agree to the following terms and conditions without objection. 

• Apparel Orders: Minimums vary by category (i.e. 36 units for apparel, 12 hats,  12 bags)
• Signage & Promotional Items: Yard sign orders require a 10-unit minimum. Vinyl decals and banners may carry separate minimums.
• Below Minimum Orders: May be accepted on a case by case basis and if necessary may require a 1.3-2.0x surcharge per unit. (ie. standard pricing is $12/unit - surcharge pricing is $16/unit)
• Creative Services: Market Pricing  $80+/hr - authorization required for sharing and producing any artwork done by Cactus Graphics 

• Full payment is required at the time of order approval unless otherwise arranged.
• We accept major credit/debit cards, checks, and cash.
• Orders through online stores (e.g., team/group shops) must be prepaid and are non-refundable
• Orders do not include shipping - shipping can be arranged for an additional fee 

• Standard  lead time estimate  is approximately  3-6 weeks  from final design approval and full payment.
• Rush orders are not guaranteed, subject to availability, though may be accommodated with  lead times of 1-3 weeks  and carry a surcharge between 1.5-2.0x/unit. (i.e. standard pricing is $12, rush order pricing is between $18-$24/unit) 

• Clients are responsible for providing high-resolution artwork or logos.
• If artwork creation or formatting is required, a one-time artwork fee of $30+ may apply.
• All artwork remains the property of Cactus Graphics unless otherwise agreed in writing.
• In select cases, Artwork and Creative Services may be for purchase and will be accompanied by an official authorization release as well as artifices in specified format 

• A digital proof is provided before production.
• Approval is required in writing. Delays in approval will delay production timelines.
• Once approved, Cactus Graphics is not responsible for any errors in spelling, sizing, or layout.
• Cactus Graphics will do our best to accommodate requests, though sometimes customer requests have production limitations, we reserve the right to provide out best viable option if a customers request is deemed not feasible to produce. 

• Due to the custom nature of our products, all sales are final - no refunds or returns are provided 
• Defective or misprinted items must be reported within  2  days of pickup or delivery.
• Customer Acknowledges Decorating is not perfect, and at times there will be slight cosmetic errors. Products are inspected and will pass quality check as long as a) the product is not damaged b) the decoration is clear and readable c) the majority of the garment is otherwise unaffected 
• our team will repair decorations to meet the above criteria 
• products with cosmetic errors will move forward on your order at a discounted price between 30-40%
• reprints will be offered in the instance the product a) is damaged b) decoration is printed upside down or incorrect placement c) the decoration is damaged and effects the readability as intended 

• Items not purchased through Cactus Graphics are handled at the customer’s risk and subject to refusal for any reason at our sole disrcetion 
• Garments must be new, we do not work on used garments 
• Embroidery/logo application on outside items is subject to:
  
  • $5 handling fee (under 20 items)
  • $8 fee (under 6 items)
  • $0 for 20+ units
• Cactus Graphics is not responsible for damage to customer-supplied items.

Cactus Graphics shall not be liable for any indirect, incidental, or consequential damages arising from the use or misuse of our products or services.

These Terms & Conditions are governed by the laws of the State of New Hampshire, without regard to conflict of law provisions. **NOTE - all designs and mockups shared are property of Cactus Graphics NH, and are not authorized to be shared, or reproduced without our explicit permission. Creative works by Cactus Graphics are considered Intellectual property of Cactus Graphics, and the unauthorized use of such property may be considered theft, which is prosecutable by laws**

The above is the most clear outline of our terms and conditions of service, we reserve the right to modify, add, and subtract any and all of  these terms at any time and without notice. The customer agrees in certain cases there are terms that are not shared on this website and may not be implemented until the time of enacting.
